The Pennsylvania Insurance Department published a notice in the Pennsylvania Bulletin dated Saturday, February 7, 2026 (filed for public inspection February 6, 2026, at 9:00 a.m.) announcing its annual workers’ compensation Special Schedule “W” data call under section 655 of The Insurance Company Law of 1921 (40 P.S. § 815): Insurance companies writing workers’ compensation insurance in the Commonwealth must submit complete and accurate Schedule “W” information on or before April 16, 2026.
Additionally, the Department plans to begin enforcement of penalties for late reporting beginning with this Schedule “W” data call due April 16, 2026.
The Pennsylvania Insurance Department explains that the premium and loss experience reported on Schedule “W” is used to determine assessments funding the Subsequent Injury Fund, Supersedeas Fund, Workers’ Compensation Administration Fund, Uninsured Employers Guaranty Fund, and the Office of Small Business Advocate, including deductible-layer information used in assessment calculations alongside experience reported net of deductible business.
For insurers, underwriting, finance and compliance teams handling Pennsylvania workers’ compensation, the notice underscores that section 655 provides that any carrier failing to submit a timely Schedule “W” shall forfeit $100 for each day the neglect continues and, upon notice by the Pennsylvania Insurance Commissioner, the carrier’s authority to do business shall cease while such default continues; the Pennsylvania Insurance Department adds it is imperative that Schedule “W” be completed accurately and on time.
Consistent with prior data calls, the Pennsylvania Insurance Department says the cover letter and instructions are available on its website, and that reporting should be made via the Pennsylvania Compensation Rating Bureau’s Financial Data Manager (FDM) — including coal mine experience — rather than submitted directly to the Department.
