In Notice 2026-05 published February 21, 2026 (56 Pa.B. 1084), the Pennsylvania Insurance Department said during calendar year 2026, no contributions will be required to maintain the balance of the state’s Workers’ Compensation Security Fund.

The Department would require insurance industry members forward contributions if the Fund’s balance were reduced below $500,000,000, according to Section 9(1) of the Workers’ Compensation Security Fund Act (77 P.S. § 1059(1)). As of its evaluation dated December 31, 2025, the Fund’s balance exceeded $500 million, the Pennsylvania Insurance Department reported.

Pennsylvania’s Workers’ Compensation Security Fund functions as a guaranty fund that pays state workers’ compensation benefits when the insurer that provided coverage is placed into court-ordered liquidation.

The Pennsylvania Insurance Department stated that insurers writing workers’ compensation insurance in the Commonwealth of Pennsylvania will not be required to submit contributions to the Fund in 2026, a point issued by Insurance Commissioner Michael Humphreys.
