Colorado’s General Assembly has passed a bill that places a financial penalty on homeowners’ insurance carriers that fail to provide policy documents in a timely manner.

House Bill 25-1322 requires that a homeowner’s insurance carrier make available a certified copy of a policyholder’s insurance policy within thirty calendar days after receiving a written request. The request must be sent to the insurer’s registered agent, according to the bill.

If the insurer does not comply by the thirty-first calendar day, it becomes subject to a penalty of fifty dollars per day, which continues to accrue until the certified copy is made available to the policyholder.

In addition, the bill holds the insurer responsible for reasonable attorney fees and costs incurred by the policyholder in enforcing this requirement.

The legislation also amends Colorado Revised Statutes section 10-4-110.8, mandating that every homeowner’s insurance carrier make available an electronic or paper copy of the policyholder’s insurance policy - including the declaration page and any endorsements - within three business days of a request. The policyholder may determine the preferred method of delivery.

The act applies to requests made on or after the effective date, which is set for 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the General Assembly. However, if a referendum petition is filed under section 1 (3) of article V of the state constitution, the law would take effect only if approved by voters at the November 2026 general election.

The bill was sponsored by Representatives Carter and Espenoza and Senators Exum and Roberts, with several co-sponsors named in the official text.
